Both estate duty and capital gains tax are payable upon death, which is perceived as giving rise to double taxation. The estate duty raises limited revenue and is cumbersome to administer. Moreover its efficacy is questionable: many wealthy individuals escape estate duty completely through trusts and other means. Taxes upon death will be reviewed.

The question of whether estate duty as a form of tax collection should be scrapped has been discussed in the past and is currently under review by the authorities.

What is a fact is that the levying of estate duty and CGT on death has a double taxation impact on the estate of the deceased.

According to SARS' statistics, the collection of estate duty only contributes to around 0,02% of total revenue collected.

The question now arises is:
What is the future of "Inter Vivos Trusts", should estate duty be abolished?
 
 
 
Some of the concerns that arise when a proper estate planning process is conducted are:

Badly drafted wills
Complicated or inefficient trust structures
Maintenance or accrual claims
Cash shortfalls
 

The setting up of a trust must not only look at estate duty savings, but the purpose should be:

Asset protection
Protection of minors
Wealth creation and protection
Tax savings
 

If a trust is established with these purposes in mind, it will always offer far greater benefits than just a tax saving (estate duty).

It can further be assumed that should estate duty be abolished, then donations tax will also fall away.

This will result in assets being transferred to a trust more quickly and easier and the trust as a wealth protection vehicle will be utilised more efficiently.

Assets that are being held in a trust can now be used by the trust beneficiaries, free of estate duty, free of CGT, free of executors' fees.
